Information on Results of Investigation of Criminal Cases on Domestic Violence in 2020 in Proceeding of RA Investigative Committee

In 2020 730 criminal cases on domestic violence have been investigated and 455 materials on domestic violence have been prepared in the proceeding of the RA Investigative Committee (hereafter referred to as the Committee).

Out of the mentioned 730 criminal cases on domestic violence

7 was initiated according to the Article 104 of RA Criminal Code (murder),

3 – according to the Article 109 of RA Criminal Code (causing death by negligence),

9 -  according to the Article 110 of RA Criminal Code (causing somebody to commit suicide),

1 – according to the Article 111 of RA Criminal Code (abetment of suicide),

18 - according to the Article 112 of RA Criminal Code (infliction of willful heavy damage to health),

10 - according to the Article 113 of RA Criminal Code (infliction of willful medium-gravity damage to health),

31 - according to the Article 117 of RA Criminal Code (infliction of willful light damage to health),

404 - according to the Article 118 of RA Criminal Code (battery),

13 - according to the Article 119 of RA Criminal Code (causing strong pain or mental sufferance),

3 - according to the Article 120 of RA Criminal Code (inflicting grave damage through negligence),

5 - according to the Article 131 of RA Criminal Code (kidnapping),

3 - according to the Article 133 of RA Criminal Code (illegal deprivation of freedom),

78 - according to the Article 137 of RA Criminal Code (threat to murder, to inflict heavy damage to one’s health or to destroy property),

5 - according to the Article 138 of RA Criminal Code (rape),

4 - according to the Article 139 of RA Criminal Code (violent sexual actions),

1 - according to the Article 140 of RA Criminal Code (forced violent sexual acts),

11 - according to the Article 141 of RA Criminal Code (sexual acts with a person under 16),

5 - according to the Article 142 of RA Criminal Code (lecherous acts),

2 - according to the Article 144 of RA Criminal Code (illegal collecting, keeping, use and dissemination of information pertaining to personal or family life),

16 - according to the Article 167.1 of RA Criminal Code (preventing a parent or other close relative from having a child visit),

5 - according to the Article 168 of RA Criminal Code (sale or purchase of child for the purpose of taking up care),

6 - according to the Article 169.1 of RA Criminal Code (reporting false information to Civil Status Act Registration Bodies),

2 - according to the Article 170 of RA Criminal Code (failure to fulfill or improperly fulfill the duty of raising a child),

16 - according to the Article 173 of RA Criminal Code (willful evasion from supporting one’s child by the parent),

8 - according to the Article 185 of RA Criminal Code (willful destruction or spoilage of property),

2 -  according to the Article 186 of RA Criminal Code (destruction or damage inflicted to property by negligence),

35 - according to the Article 353.1 of RA Criminal Code (willful failure to carry out an effective court sentence) and 27 – according to other articles of RA Criminal Code.

Within the above-mentioned criminal cases 342 persons have been involved as a defendant, moreover 2 – between 14 and 18, 116 – between 18 and 35, 224 – over 35.

13 of the crimes committed in the family have been committed by mother, 33 – by father, 1 – by step mother, 1 – by step father, 20 – by brother/sister, 5 – by grandmother/grandfather, 33 -  by son/daughter (among them adopted ones), 12 – by wife, 200 – by husband, 8 – by grandson/granddaughter, 5 – by husband’s parents, 14 – by daughter-in-law/son-in-law.

10 of the mentioned persons have been previously convicted.

Within the criminal cases investigated in the proceeding there have been 597 injured 53 of which have been under 12, 15 – between 12 and 14, 17 – between 14 and 16, 7 – between 16 and 18, 218 – between 18 and 35, 287 – over 35.

In 2020 507 criminal cases on domestic violence have been completed.

Proceeding of 358 criminal cases has been terminated 126 of which on acquittal, 232 – on non-acquittal base.

144 criminal cases with the bill of indictment have been sent to court.

5 criminal cases have been sent to court with a motion to use compulsory medical measures.

Proceeding of 25 criminal cases has been suspended 14 of which based on the circumstance that the person is under prosecution, 11 – on other bases.

In 2020 71 criminal cases have been combined, 16 criminal cases have been sent according to subordination, 11 criminal cases have been incomplete.
